English-language evidence on a family route depends on the application stage and any applicable exemption. Check the accepted evidence for entry, extension or settlement instead of applying Skilled Worker language requirements to a partner application.
Confirm the test provider, qualification or exemption route before paying. Keep names and references consistent with identity documents and earlier successful evidence where relevant.
Choose the evidence route before booking a test
A British sponsor may speak English with their partner every day, but that does not replace the evidence required by the application. Start with the applicant's nationality, qualifications and previous immigration decisions. The family route accepts specified ways of demonstrating English, including eligible degrees and an approved Secure English Language Test. Ordinary language school attendance, a workplace reference or an online proficiency score should not be assumed sufficient. Match the evidence to the actual family application rather than a university admission requirement. [1]
Make a short evidence record showing the applicant's name, the qualification or test reference, the date awarded and the application in which it was previously accepted. Retain the decision as well as the certificate. This helps distinguish evidence that genuinely supported a successful application from something that was merely uploaded with a refused or withdrawn application. A change of surname should be supported by the relevant linking document.
Understand the progression between application stages
For a first partner application, the published family guidance identifies A1 as the minimum test level where the testing route applies. At the usual extension after two and a half years, an applicant who previously passed A1 will generally need at least A2 in speaking and listening. A higher test already taken may be reusable, subject to the applicable conditions. These family requirements are separate from the English rules for sponsored employment. [1]
Settlement is another assessment, with its own requirements and possible exemptions. Passing a test for the initial visa does not itself establish readiness for indefinite leave to remain. Work backwards from the anticipated application date and allow time for preparation, an available appointment and a retake if necessary. Do not leave the first check until the existing permission is about to expire. See Settlement after a partner route when planning the longer sequence.
Check degree evidence carefully
The awarding institution matters. Current guidance distinguishes an eligible degree awarded by a UK institution, including where study took place overseas, from a qualification awarded by an overseas institution. For the latter, an Ecctis assessment may be needed to establish the relevant equivalence and that the course was taught in English. The current service provides a verification code; previous accepted Ecctis assessment evidence may also remain usable under the published guidance. [1]
Check the exact award rather than relying on the university's general teaching language. A transcript, provisional results sheet and final degree certificate perform different functions. Where the certificate is missing, investigate the permitted alternative evidence before paying for a test that might be unnecessary. Keep the institution's name and qualification title consistent across the application, assessment and translation, particularly after institutional mergers or changes in spelling.
Assess exemptions against the person's circumstances
The guidance lists exemptions linked to specified nationalities, age, certain application circumstances and a physical or mental condition preventing compliance. An exemption is not established simply because a test would be inconvenient, expensive or stressful. Where a medical condition is relevant, obtain an assessment of what evidence is needed and how it explains the obstacle. Share only the medical information necessary to support that issue through an appropriately secure channel. [1]
A previous exemption should be reviewed at the next stage. The reason may still apply, may have changed or may require different supporting material. Record what the earlier decision actually accepted. Avoid treating a child's exemption as evidence that an adult parent is also exempt, or assuming that a sponsor's nationality removes the applicant's language requirement. Each applicant's position needs its own conclusion.
Build a practical language evidence file
Before submission, verify the approved provider and relevant test, the booking identity, the result reference and any conditions for reusing an earlier result. A provider's familiar brand does not mean every examination it offers is accepted. Save the result in a readable format and check that any verification code has been copied accurately. If a document or test result has been withdrawn, do not rely on an old downloaded copy as though nothing changed.
Bring unresolved questions about exemptions, previous evidence or qualification recognition to an appropriately regulated or otherwise legally authorised adviser through Partner visa application coordination, subject to confirmation of the available scope. Provide the actual documents rather than a description of them. A useful review should identify the evidence route, any missing item and the date by which it must be resolved, so the English requirement fits into the wider family application timetable.
Illustrative scenario
A partner preparing an extension holds a certificate used for the first application. The adviser checks whether it satisfies the current stage rather than assuming all earlier evidence can be reused.
Preparation checklist
- Identify the application stage
- Check accepted evidence
- Review exemptions
- Verify identity details and references
Frequently asked questions
Does everyday fluency replace the required evidence?
No. The applicant must satisfy an accepted evidence route or establish an applicable exemption; conversational ability alone is not the documentary requirement.
Is A1 always enough for a partner extension?
No. The usual extension after an initial A1 test generally requires A2 speaking and listening, unless another accepted basis or exemption applies.
Can an overseas degree taught in English be used?
Potentially. Check whether an Ecctis assessment and verification evidence are required for the particular qualification and awarding institution.
Should a previous exemption be checked again?
Yes. Confirm that the exemption remains applicable and identify the supporting evidence needed for the current application stage.
