Tenancy types in England: checking current rules

Identify the tenancy regime before relying on the heading of an old agreement.

Jurisdiction: England.

Identify the tenancy regime before relying on the heading of an old agreement. In England, most existing assured shorthold tenancies became assured periodic tenancies on 1 May 2026. Lodgers, social housing and some student accommodation require different treatment. [1]

Establish the occupation facts

Record who lives at the property, whether the landlord shares accommodation, when occupation began and whether the premises are the tenant's main home. A document labelled 'licence' does not necessarily establish the legal arrangement.

Keep the original agreement and subsequent information sheets. An outdated fixed end date should prompt a rules check rather than an assumption that the tenant must leave automatically.

Use the classification for the next decision

Rent increases, notice and possession depend on the applicable regime. Identify the particular action proposed and its date. Rent increase notices and possession requirements address different procedures; neither should be selected merely because the agreement contains an old template clause.

Ask an adviser to explain any exception relied on, particularly for company lets, resident landlords or unusually high rents. Record the conclusion with its factual basis.

Start with who occupies which space

Draw a simple description of the accommodation: a whole flat, a bedroom with shared facilities, or rooms inside the owner's own home. Identify who can exclude other people from the space and which services the owner actually provides. A cleaner entering an agreed communal area does not answer whether a resident has exclusive possession of a bedroom. Give an adviser the practical arrangement as well as the signed terms; descriptions such as guest, member or licensee cannot resolve inconsistent underlying facts.

Establish whether the named tenant is an individual or a company. Where an employer arranges accommodation, distinguish a company taking the tenancy from an employee renting personally with help towards the rent. Collect the signature page, invoices and any separate occupation agreement. Also clarify whether the occupier uses the address as their principal home or for a genuinely temporary purpose. The person sending the monthly payment may be different from the person whose legal relationship needs to be classified.

Separate shared occupation from a resident landlord

Sharing a kitchen with other renters is different from sharing living accommodation with the landlord. Record whether the owner actually lives there, what rooms they use and whether that arrangement has changed. An address on correspondence or a retained key is not a complete account of residence. Where a landlord has moved into or out of the building, retain the dates and earlier agreements so advice can address the sequence instead of treating today's floor plan as the whole history.

Very old lettings and arrangements outside the usual assured category deserve an individual check. GOV.UK identifies regulated tenancies, excluded arrangements and several exclusions from assured periodic status. Those categories do not all confer the same protection. [2] A family describing someone as a longstanding tenant should look for the first agreement and evidence of subsequent changes, rather than assume a recently printed document erased the earlier relationship. A succession, transfer or replacement agreement may require closer examination than a routine address update.

Read the continuing agreement after conversion

For most existing English assured shorthold tenancies, conversion on 1 May 2026 happened by law. The absence of a replacement signature does not itself prevent the conversion. Existing written agreements are read with the new regime, and the government Information Sheet explains the changes. [1] Locate the actual documents provided to each household. A landlord who missed the delivery requirement should obtain advice about correction and consequences, rather than ask a tenant to acknowledge an earlier delivery that did not occur.

Keep the continuing practical terms visible when discussing the new legal category. The agreed property, parties, rent and responsibilities still need to be understood. Do not infer that an obsolete fixed end date means every other clause can be ignored. Equally, copying an old break clause into an email does not establish the correct present procedure. Mark clauses that appear inconsistent with current rules for review and identify the immediate decision they affect, such as a proposed departure or an instruction to an agent.

Turn the classification into a focused question

A useful request for advice states the proposed action in one sentence: for example, whether an occupier can end their agreement on a particular date. Attach the documents that establish the category and the relevant chronology. The answer may change if the arrangement is a resident landlord letting, an older protected tenancy or a company contract. Asking only whether the document is legally valid leaves the adviser to guess which consequence matters and can obscure an approaching notice or payment deadline.

If the parties disagree about classification, record each position without converting the dispute into an admission. Continue keeping evidence of rent, occupation and communications while arranging specialist housing advice. Avoid testing a disputed category by changing locks, removing possessions or stopping all payments. The practical aim is a reasoned description of this particular letting and the correct route for the next action. Preserve that conclusion with its factual assumptions so a later change of occupants or ownership prompts a fresh review where necessary.

Frequently asked questions

Does the heading AST settle the status of an agreement signed before May 2026?

No. Most existing assured shorthold tenancies converted automatically, so the occupation facts and current rules must be considered alongside the older wording.

Is a shared kitchen enough to make someone a lodger?

Sharing with other tenants differs from sharing with a resident landlord; identify who lives there and which accommodation is genuinely shared.

What should an employee bring if their employer arranged the flat?

Bring the tenancy signature page, the employer's accommodation agreement and payment records so the adviser can identify the actual contracting tenant.

Should an old tenancy be replaced simply because its status is uncertain?

Obtain advice first, since a replacement document may affect important rights and does not automatically resolve the history of the occupation.

How can I make a tenancy classification enquiry more useful?

Explain the accommodation, parties, occupation dates and proposed action, then supply the agreements so the answer addresses the decision you actually face.
