Recruiting someone on the Graduate route into a sponsored role requires a review of their current permission and the requirements of the proposed work route. Graduate permission is time-limited and does not guarantee that any future role will qualify for sponsorship.

Assess the genuine duties, salary, timing and any applicable provisions for the candidate. Keep the current employer check and the future sponsorship plan distinct.

Establish the graduate's current permission

A person who has completed a UK course may still hold Student permission, may have a Graduate application pending or may already have a Graduate visa. These are different positions. Complete the appropriate right-to-work check and read the actual conditions before offering unrestricted employment. A degree certificate or graduation ceremony does not itself change immigration permission. [1]

The Graduate route permits work in most jobs subject to its conditions and does not require an employer sponsor for that permission. However, it cannot be extended. A business intending long-term employment should discuss the future route early rather than waiting until the final weeks of the Graduate visa. Keep the conversation accurate and avoid presenting future sponsorship as guaranteed if the role has not yet been assessed.

Plan around the applicable Graduate visa duration

The current published rules distinguish applications made on or before 31 December 2026, which normally receive two years, from applications on or after 1 January 2027, which normally receive 18 months. A PhD or other doctoral qualification has a three-year period. As at this article's September 2026 review, the shorter period is a future application-date change, not the duration of every existing Graduate visa. [1]

Use the individual's actual grant and expiry dates for recruitment planning. Do not infer their remaining time from the date they graduated or from a general two-year assumption. If they are still considering a Graduate application, eligibility includes the relevant course completion report and application before Student permission expires. An employer should not advise a candidate to rush or delay an application without appropriate individual advice.

Assess Skilled Worker sponsorship for the real role

The vacancy must meet the current occupation, salary and sponsorship requirements when the worker applies. A graduate's degree does not automatically make a junior role eligible. Prepare the duties, code, hours and actual pay, then confirm the sponsor licence and CoS process. A permitted new-entrant salary option may be relevant, but it has specific conditions and a maximum period. The sponsor guidance counts relevant time on Graduate permission together with the specified sponsored routes towards the four-year new-entrant limit. Do not assume a worker receives a fresh four-year discounted period after spending two years on Graduate permission. Assess the full history and intended sponsorship length. [2]

Coordinate the transition before permission expires

Agree when the role and salary review will take place, who will approve sponsorship and what evidence the applicant needs. Consider the English requirement for switching and any other route-specific documents. The candidate may have evidence from previous study, but the applicable formal requirement still needs checking. Leave time for resolving missing information and assigning the appropriate CoS.

Until the transition is complete, the employer must rely on the individual's actual current permission and the appropriate checking evidence. If the person is still on Student permission, work restrictions and permanent-vacancy rules need specific assessment. Do not assume that an intended Graduate or Skilled Worker application has already changed those conditions. A timely application can have continuation consequences, but the employer should establish the precise basis rather than using “switching soon” as a status.

Make the longer-term offer transparent

Explain whether the business has committed to sponsorship, is assessing it or does not currently plan to sponsor. Keep any conditions clear and apply recruitment decisions fairly. A worker may make significant housing or family commitments based on an employer's statement, so avoid informal assurances that are inconsistent with the approved budget or licence position. Review dependant implications separately where relevant.

For support through Skilled Worker application coordination, provide current permission dates, course and immigration history, proposed duties and salary. Case-specific immigration advice must be delivered by an appropriately regulated or otherwise legally authorised adviser. Ask for an assessment of the current right to work, future Skilled Worker eligibility and any new-entrant time limit. The plan should identify the salary and role the business can genuinely sustain after any limited concession ends.

Keep a review date well before expiry and record the outcome of the sponsorship decision. If the intended role changes during the graduate's employment, update the assessment rather than relying on an earlier theoretical vacancy. This allows the employer and employee to plan on the basis of the job actually available.
