Separating payroll onboarding from immigration checks

Payroll onboarding and right-to-work checking should be separate tasks that are coordinated before employment begins.

Jurisdiction: United Kingdom.

Payroll onboarding and right-to-work checking should be separate tasks that are coordinated before employment begins. A tax code, National Insurance number or payroll record does not establish that the person has permission for the proposed work.

Use a shared status tracker that records completion without exposing unnecessary identity documents. Define who can confirm the start and who resolves immigration uncertainty.

Treat payroll setup and permission to work as separate decisions

Payroll onboarding establishes how the employer will calculate and report pay. Right-to-work checking establishes whether the person is permitted to undertake the proposed employment and whether the employer has the required evidence. A successful payroll record does not answer the immigration question. HMRC's new-employee guidance treats collecting starter information and checking the right to work as separate parts of taking on staff. [1]

Create two linked completion states rather than one broad “onboarded” label. Payroll may have the bank details, starter declaration and tax information while HR is still resolving immigration evidence. Conversely, the right-to-work check may be complete while a missing P45 requires the appropriate payroll process. Each team should know what is outstanding without assuming the other team's progress authorises the first working day.

Do not use tax identifiers as immigration approval

A National Insurance number is useful for payroll administration and appears in certain accepted manual document combinations. It is not standalone proof that a person can undertake any job. A P45, payslip or previous tax record likewise does not replace the prescribed right-to-work check. The person may have had permission for different work, or their circumstances may have changed since the earlier employment. [2]

Use the appropriate Home Office online, manual or qualifying digital identity route and retain the required evidence. Where a listed manual combination includes National Insurance evidence, check the complete combination rather than treating the number alone as sufficient. Our guide to Recruiting British and Irish citizens: check routes explains the relevant British and Irish evidence options. Payroll staff should refer immigration questions to the designated checker rather than improvising from tax documents.

Build a controlled start instruction

The recruitment owner should confirm the actual employing entity, agreed start date and completion of required pre-employment checks. Payroll then uses that authorised information for its own setup and reporting obligations. If the immigration check is unresolved, the internal status should say so explicitly. Equipment delivery, system access or an induction invitation should not silently change the case to ready for work. [2]

Keep changes synchronised. If the start is deferred, update the employment correspondence, rota, payroll instruction and any sponsorship planning affected by the change. Do not simply change the payroll date while allowing paid training or ordinary duties to begin earlier. The business needs one factual employment chronology even though different teams have different legal responsibilities within it.

Use payroll changes as alerts for immigration review

Pay and hours data can reveal a change that needs assessment, such as a student taking extra shifts or a sponsored worker moving to a different salary or role. Payroll should flag the agreed categories of change to the responsible HR or sponsorship contact. It should not decide independently that a higher salary removes all immigration restrictions or that a lower payment always means permission has been breached.

The immigration review may need to consider the contract, actual duties, permitted hours, absence reason and sponsor rules. Keep the resulting instruction specific: approved hours, effective date, reporting action or further evidence needed. Routine overtime and payroll corrections should be classified accurately, rather than sending every minor adjustment into an undefined “visa issue” queue that nobody owns.

Retain each record for its proper purpose

Payroll and right-to-work records have different retention requirements and access needs. HMRC's starter-information guidance specifies its payroll record period, while the Home Office requires right-to-work evidence throughout employment and for two years afterwards. Do not delete an immigration profile because a payroll archive is being cleared, or retain every identity document indefinitely because some financial records must remain available. [1] [2]

For help through Employer right-to-work process review, explain the onboarding handover or recurring data mismatch first. Immigration advice must be provided by an appropriately regulated or otherwise legally authorised adviser, while payroll treatment may require tax expertise. Share the minimum relevant records securely. A useful review results in clear ownership, separate completion criteria and a start authorisation that managers can understand without accessing confidential payroll and immigration files together.

Reconcile the active workforce periodically where there is a concrete reason to suspect a handover problem, such as a system migration or repeated unauthorised start instructions. Compare people actually working with the check register and payroll list, investigate discrepancies and record the resolution. The purpose is to identify a real gap between employment activity and the evidence supporting it.

Illustrative scenario

A payroll team receives complete starter details but the right-to-work check remains open. The hiring manager waits for the authorised checking decision before confirming that work may begin.

Preparation checklist

  • Assign separate task owners
  • Track both completion states
  • Protect personal documents
  • Confirm permission before work starts

Frequently asked questions

Does a National Insurance number prove someone can work?

No. It is not standalone immigration evidence. It may form part of specified acceptable manual combinations, which must be checked in full.

Can payroll setup be completed before the immigration check?

Administrative preparation can progress separately, but it must not be treated as authorisation to start work. The required right-to-work check remains a distinct condition for the start decision.

Should payroll decide whether a sponsored salary change is allowed?

Payroll should flag the change to the responsible immigration or sponsorship decision-maker. The assessment can involve duties, hours, route rules and reporting requirements beyond payroll calculation.

Should all onboarding records share one deletion date?

No. Apply the appropriate retention basis to each record category and coordinate any legal hold or other specific obligation rather than using one blanket period.
