Government guidance sets out registration with the Office of the Public Guardian for lasting powers of attorney in England and Wales. [1] The current procedure and relevant charges should be checked when the work is accepted. Different arrangements elsewhere in the UK are outside this page's assumed scope. Establish a complete document record
Provide information about the signed document and any related forms before sending originals. The preparation can record the version, pages and correspondence available, and identify apparent gaps for professional attention. It does not certify that signing, witnessing or other formal requirements were satisfied. Those questions need the appropriate review rather than a conclusion based only on a scanned file.
Keep the sequence of documents clear if corrections or replacements have been considered. An altered page should not be treated as an approved amendment simply because it has been added to the pack. The responsible professional should assess how any problem can be addressed. We do not backdate signatures, recreate a missing witness act or imply that an administrative correction resolves every defect.
Allocate submission and payment responsibilities
The engagement should identify who prepares the submission, who approves it and who sends the required documents. Where an official payment or application for a reduction is relevant, the evidence and responsibility should be stated. Fees quoted for assistance should distinguish professional charges, applicable VAT and government costs rather than imply a single unverified inclusive amount.
Authority to act and access personal information should be established before correspondence is handled. A relative arranging an appointment is not automatically entitled to all donor records. The preparation can identify the appropriate contact and agreed communication channel. It does not grant power to make decisions for the donor or authorise use of the LPA before the applicable conditions are met.
Prepare for official questions and timing
If the authority has already written, provide the complete message and any response date. The review should address the actual question rather than rely on a general description that the application was rejected. A coordinator can organise a query log and supporting documents. Legal advice on validity, objections or disputed authority needs an expressly accepted professional scope.
Processing depends on the authority and the circumstances, including any missing information or objection. No registration date or successful result is guaranteed. A preferred family or transaction deadline should be recorded, but it does not control official processing. If an urgent decision must be made before registration, seek appropriate advice rather than assume an application receipt provides the necessary authority.
Plan the registered document handover
The accepted work can include a submission responsibility sheet, correspondence record and handover questions. Identify who will retain originals and how authorised people will obtain the evidence needed for later use. Third-party organisations may need their own verification. Registration assistance does not guarantee that a bank or another body will accept incomplete proof or every proposed attorney action.
Start with the LPA status, intended applicant and any official correspondence to request a quotation in GBP. The engagement should state its limits and any separate professional review required. Keep later queries with the same file. The objective is organised registration support with clear accountability, not a promise of approval, immediate authority or unrestricted use of the instrument.
