Read the individual's permission before allocating hours

A student immigration route does not give every student the same permission to work. Some can undertake limited work during term time, some have different restrictions and some cannot work. Begin with the prescribed right-to-work check and read the actual conditions for the individual. Do not assume that enrolment at a British university automatically permits a standard number of weekly hours. [1]

Record the restriction in a form that the rota manager can use without viewing the whole immigration file. The instruction should identify any term-time limit, relevant dates and work that is prohibited. Keep the underlying check evidence securely with HR. A generic payroll label saying “student” is not enough to tell a supervisor whether an additional weekend shift would breach the employee's conditions.

Obtain course-specific term and vacation evidence

Where work is permitted subject to term-time restrictions, the employer needs evidence of the academic term and vacation dates covering the employment. The Home Office guidance describes evidence from the education provider, including published dates or appropriate correspondence. Check that it relates to the person's actual course and study period. Postgraduate research or dissertation periods may not follow a general undergraduate holiday calendar. [1]

Ask the student to explain any apparent conflict between a university webpage and a course-specific letter, then verify the appropriate dates. Do not assume that a quiet teaching week or a period without lectures is a vacation. Keep the relevant evidence and update it when the course timetable changes. A manager's recollection that “students can work full time in summer” is not an adequate basis for scheduling unrestricted hours.

Count work across the whole relevant week

For the student working limit, the current guidance treats a week as running from Monday to Sunday. The permitted limit is not reset by each employer or averaged over a month. Ask the employee about other work that affects the restriction and explain why accurate information is necessary. The business should plan its own shifts using the total permitted position, not assume its rota is the only work undertaken. [1]

Distinguish genuine volunteering from voluntary work, because unpaid activity is not automatically outside the limit. A role with contractual obligations or payment in kind may need closer assessment. Avoid asking the employee to “volunteer” extra hours to get around a restriction. Where classification is uncertain, obtain appropriately authorised immigration advice before the additional activity begins rather than trying to correct the records afterwards.

Check the type of role as well as the hours

An acceptable number of hours does not make every occupation or arrangement permissible. Student conditions can restrict particular activities and permanent full-time vacancies, with specific exceptions for qualifying transitions to other routes. Check the actual rule and the person's circumstances before treating an expected Graduate or Skilled Worker application as permission to move into an unrestricted permanent role. [1]

Keep the proposed job description, contract and rota consistent with the conclusion reached. If a student wants to increase hours after finishing a course, confirm the relevant course completion evidence, the remaining permission and any applicable conditions. Build restrictions into everyday scheduling

Assign someone to monitor the next academic period and any permission expiry. Rota software should flag the agreed limit before shifts are approved, with an escalation process for conflicting information or last-minute cover. Keep records of hours actually worked, not only planned hours. If an overrun is identified, preserve the facts and seek advice promptly; editing the timesheet to fit the limit creates a further problem.

Discuss restrictions with the employee respectfully and make clear that they should report changes in course status, permission or other work relevant to the agreed schedule. Individual immigration advice must come from an appropriately regulated or otherwise legally authorised adviser. The practical objective is a lawful, workable rota supported by evidence, rather than a one-off document check that is forgotten during busy periods.

At each term change, confirm that the manager has received the current scheduling instruction and knows who can approve an exception. An employee's willingness to cover a shift cannot authorise work outside their immigration conditions. Clear ownership reduces pressure on students to interpret complex rules themselves while standing at a workplace rota board.
