Check the study milestone that permits switching

The Skilled Worker switching guidance sets additional conditions for applicants currently on Student permission. It identifies alternatives involving completion of the sponsored course, a job start after the course finishes or the specified period of full-time doctoral study. Establish which condition applies and obtain reliable evidence from the education provider. An employer's preferred start date cannot make an unfinished course complete or replace the required study history. [1]

Record the course end, actual completion position, current permission expiry and intended application date. A dissertation submission, examination board decision and graduation ceremony may fall on different dates. Ask the adviser which evidence establishes the relevant milestone for the proposed switch. Do not use a date selected for recruitment convenience if the institution's records support a different position.

Assess the employer and the genuine role

The employer needs the appropriate sponsor authorisation and a role that meets the Skilled Worker requirements. Review the actual duties, occupation code, skill eligibility, salary and working hours. A job title such as graduate consultant does not itself establish eligibility. The sponsor should select the code reflecting the work, not one chosen because its salary requirement appears easier to meet. Keep the job description consistent with the contract and sponsorship record. [2]

If the employer does not yet hold the necessary licence or allocation, include that process in the timetable. A promise to sponsor is not the same as a valid Certificate of Sponsorship or an approved visa. Do not ask the student to begin unauthorised duties while the business completes its paperwork. Recruitment and immigration planning need to be coordinated before a firm start commitment is made.

Apply salary and English provisions to the individual

Some applicants may qualify under a new-entrant salary option, but being a recent graduate does not make every discounted calculation available. The detailed sponsor guidance sets conditions and limits the combined period under the relevant new-entrant provisions, including relevant Graduate permission. Assess the proposed sponsorship duration as well as the initial salary. A salary that qualifies for a short grant may not support the longer period the employer intends. [2]

Check the English requirement for the actual application and any accepted evidence from earlier study or immigration history. Current Skilled Worker English provisions differ from an ordinary family visa and include the relevant changes for first applications from January 2026. Do not assume that a university admission letter alone resolves the evidence requirement. Keep the qualification or test details available for the specific assessment.

Separate permission to apply from permission to start work

Meeting a switching condition does not automatically remove existing Student work restrictions on the day the job offer is signed. The employer must assess what work is permitted before the new decision, including any specific exception that may apply to a qualifying pending application. Obtain a clear conclusion based on the person's circumstances rather than treating every submitted application as authority for unrestricted permanent employment. [1] [2]

If the student continues working under existing conditions while waiting, the rota and duties must remain within those conditions. After the new grant, complete the appropriate check and confirm the lawful start arrangement. Keep the decision and sponsorship dates aligned with payroll and the employment contract.

Coordinate family applications and the decision period

The switching guidance says a partner's or child's visa does not automatically switch when the main applicant changes route. Assess each dependant's eligibility and expiry, including any occupation-specific restrictions. A family should not assume that the same dependant options apply to every sponsored role. Plan the cost and evidence for each application and preserve separate confirmations. Travel outside the Common Travel Area while the in-country application is pending also has withdrawal consequences. [1]

Through Student application enquiry, request an appropriately regulated or otherwise legally authorised adviser where immigration assessment is available within the confirmed scope. Provide the course evidence, current permission, proposed duties, pay, sponsor details and family circumstances. The written plan should distinguish eligibility, submission timing and lawful commencement of work. It should not promise that a British degree or an employer's willingness to recruit automatically produces Skilled Worker permission or a particular decision date.
