Student work restrictions: employer considerations

An employer considering a student applicant should check the actual work conditions and relevant term dates before agreeing shifts.

Jurisdiction: United Kingdom.

An employer considering a student applicant should check the actual work conditions and relevant term dates before agreeing shifts. Student status does not give everyone the same permitted hours, and a university offer is not an employer right-to-work check.

Use course-specific evidence where required and review multiple jobs or placements. The employer must not rely only on the worker’s informal estimate of available hours.

Complete the employer's check before agreeing unrestricted shifts

A British employer should establish the student's actual right to work using the prescribed employer process. An offer letter from a university, student identity card or screenshot supplied by the applicant is not a substitute for the relevant check. Read the conditions shown by the official result and verify that the person presenting for work is the holder. Keep the evidence and date in accordance with the current employer guidance. [1]

Do not assume every international student has permission for twenty hours of work. The conditions can depend on the course, sponsor and immigration permission, and some students cannot work. The Student overview also identifies restrictions on self-employment and certain occupations. Establish the individual's position before a manager promises a rota, freelance arrangement or role that their permission does not allow. [2]

Obtain term dates for the actual course

Where work is limited during term time, retain evidence of the relevant academic term and vacation dates covering the employment period. The employer guidance allows appropriate evidence from the education provider. A general university holiday webpage may not describe the student's particular programme, especially for postgraduate research or a dissertation period. Ask for course-specific confirmation where the calendar is unclear instead of treating the summer months as automatic vacation. [1]

Record who supplied the dates and when they were checked. If the course timetable changes, update the rota controls. A student's statement that classes have finished may be true but does not necessarily mean the institution regards the period as a vacation. Distinguish teaching sessions, assessment, dissertation work and formal course completion when deciding which work conditions apply.

Count hours across the whole permitted week

The current employer guidance uses a week running from Monday to Sunday for the relevant student work limit. Hours should not be averaged across several weeks to excuse an excess in one week. Ask about other employment and relevant voluntary work so the student does not exceed the total permitted hours across jobs. A rota that is compliant for one employer can still contribute to a breach when another employer's shifts are added. [1]

Agree a practical reporting process for changes in other work and keep records of actual hours, including additional shifts. Do not label ordinary work as volunteering or training to avoid the limit. Voluntary work and genuine volunteering can require different consideration, and an unpaid arrangement is not automatically outside the work rules. Refer uncertain arrangements for assessment before adding them to the schedule.

Review placements and permanent roles separately

A course-related placement may have specific conditions and evidence requirements. Confirm its relationship to the course and the relevant permission rather than assuming every internship is authorised. Keep the provider's confirmation and the placement arrangements distinct from ordinary part-time work. If the student is being offered a permanent full-time role, check the restrictions and any applicable switching exception; course completion alone should not be treated as unrestricted permission to fill any vacancy. [1]

A pending Graduate or Skilled Worker application can raise a different set of conditions from an approved grant. HR should obtain an assessment of the current position and complete any required follow-up check before changing the working arrangement. Use Changing from study to sponsored work where the employer proposes sponsorship after study, and do not rely on an application receipt as though it were a new visa with different work rights.

Build the restrictions into everyday scheduling

Tell the line manager what limits apply and maintain a way to prevent excess shifts before they are worked. Record the permission expiry and the next check where required. If the student reports a course change, withdrawal or new immigration decision, review the evidence promptly. The employer's responsibility is not discharged by collecting a declaration once and then ignoring changes that affect the person's permission.

Through Student application enquiry, ask whether an appropriately regulated or otherwise legally authorised adviser can assess uncertain immigration conditions within the confirmed scope. Provide the official work-check result, course calendar and proposed duties and hours, using a secure channel for personal data. The practical outcome should be a lawful rota and a clear follow-up process. It should not rest on assumptions that all students share the same limit, that unpaid work never counts or that academic holidays are identical across every programme.

Illustrative scenario

A student requests extra shifts during a period they call a holiday. HR checks the relevant course calendar and permission before approving the rota.

Preparation checklist

  • Complete the employer check
  • Read work restrictions
  • Retain relevant term dates
  • Monitor agreed working hours

Frequently asked questions

Can all Student visa holders work twenty hours each week?

No. Read the individual's actual conditions; the permitted work can vary and some students have no work permission.

Can hours be averaged across a month?

Do not use averaging to exceed a weekly limit. The current employer guidance uses Monday to Sunday for the relevant student working week.

Is summer automatically a vacation for postgraduate students?

No. Obtain the relevant course dates and clarify dissertation or research periods with the education provider where necessary.

Does applying for a Graduate visa immediately remove Student work restrictions?

Do not assume so. Assess the current permission and any applicable pending-application conditions before changing the role or hours.
